موت الكفيل لا يبطل الكفالة
الكفالة هي ضم ذمة إلى ذمة في المطالبة بتنفيذ الالتزام المادة (1008 مدني) وان موت الكفيل لا يبطل الكفالة ويلزم الورثة بتسديد الدين المكفولة من تركة مورثهم كسائر الديون الأخرى ثم يعود الورثة على المكفول عنه عند حلول الأجل.
