The Digital ID Act 2024 explicitly states that individuals have the right to choose whether or not to create or use a Digital ID.
Service providers, including businesses and government departments, are prohibited from making the creation or use of a Digital ID a condition for accessing their services.
If a service provider requires a Digital ID, they must offer an alternative, reasonably accessible method that does not involve a Digital ID.
The Australian Competition and Consumer Commission (ACCC), acting as the Digital ID Regulator, enforces these rules and can take action against providers who violate them.
While some concerns have been raised about potential future mandatory use or coercion, particularly regarding access to certain services like the NDIS portal, the law currently mandates that participation must be voluntary.
