Can your condo by laws stop you from renting out your unit? The answer is NO. The Building and Construction Authority (BCA) has clarified that condo by-laws cannot restrict an owner’s right to rent out their property. Whether your tenant is a local family, an Employment Pass holder, an S Pass holder, or a Work Permit holder (subject to prevailing government regulations), the MCST cannot create by-laws that take away your legal right to lease your unit. This is an important reminder that: ✅ Your property ownership rights are protected by law. ✅ MCSTs can regulate the use of common property, but they cannot make by-laws that override an owner’s right to lease their unit. That said, this doesn’t mean all rentals are automatically allowed. Owners and tenants must still comply with: • URA’s minimum rental period • Occupancy limits • Immigration and housing regulations • Any other applicable government requirements Knowing your rights is just as important as knowing your responsibilities.
